While the Medicare Secondary Payer (MSP) Act applies equally to liability claims and workers’ compensation claims, the MSP compliance industry has been much more concerned about things from the workers’ compensation side historically. However, given CMS’ recent announcement that it is considering expanding its official Medicare Set-Aside (MSA) review process to include liability MSAs (LMSAs), now is the time to appreciate how important MSP compliance is for liability claims. Mr. Cattie, a MSP compliance attorney and MSP subject matter expert will discuss how the same MSP compliance concerns of Section 111 reporting, conditional payment reimbursement for past medicals and MSAs for future medicals applies equally in the liability insurance context. After covering the statutory and regulatory ground, he will share his best practices for ensuring that you minimize (or even extinguish) your MSP exposure to the federal government.

John V. Cattie, Jr., JD/MBA, a Medicare Secondary Payer (MSP) subject matter expert, heads the Future Cost of Care Practice for Garretson Resolution Group (GRG), counseling attorneys nationwide on compliance issues related to the Medicare Secondary Payer Act, including the applicability and use of Medicare Set-Aside Arrangements (MSAs) as part of workers' compensation, liability, and no-fault settlements.

 John joined GRG in 2008. Serving as a neutral third party with respect to Medicare compliance, John is a member of DRI, American Association of Justice (AAJ), Claims and Litigation Management Alliance (CLM) and National Association of Medicare Set Aside Professionals (NAMSAP). Within DRI, John serves as the Chair of the DRI Medicare Secondary Payer Task Force, leading DRI’s efforts to provide MSP compliance updates and education to its over 22,000 attorney members. He is a frequent speaker at continuing education events nationwide on the subject of MSP compliance.

Prior to joining GRG, John was an attorney with Moore & Van Allen where he conducted buy-side due diligence efforts for corporate merger and acquisitions.
